Section 52 Mental Health Act

The mental health act says when you can be taken to hospital kept there and treated against your wishes.
Section 52 mental health act. 1 where the district court records a finding that the alleged mentally ill person is in fact mentally ill and is incapable of taking care of himself and of managing his property it shall make an order for the appointment of a guardian under section 53 to take care of his person and of a manager under section 54 for the management of his property. This can only happen if you have a mental disorder that puts you or others at risk.

52 1 this section has effect where a transfer direction has been given in respect of any such person as is described in paragraph b of section 48 2 above. 2 this act comes into operation on such date as the minister may appoint by notification in the gazette and the minister may appoint different dates for the coming into operation of this act or of different provisions of this act in different parts of malaysia. This ensures their immediate safety whilst the assessment is arranged.

Section 5 2 is a temporary hold of an informal or voluntary service user on a mental health ward in order for an assessment to be arranged under the mental health act 1983.
