Section 6039. Prior to amendment par. 2 read as follows. A in generalevery employer maintaining a specified fringe benefit plan during any year for any portion of which the applicable exclusion applies shall file a return at such time and in such manner as the secretary shall by regulations prescribe with respect to such plan showing for such year 1 the number of employees of the employer 2.
Prior to the amendment made by the act the treasury department and the irs issued 2 regulation 1 6039 1 effective on august 3 2004. In 2010 the internal revenue service irs adopted regulations under section 6039 of the internal revenue code. For inflation adjustment of certain items in this section see revenue procedures listed in a table under section 1 of this title.
Section 6039 as amended by the act applies to stock transfers occurring on or after january 1 2007. 6039 form filing services beginning in tax year 2010 the irs requires reporting of iso incentive stock option exercises on a form 3921 and espp employee stock purchase plan transfers purchases on a form 3922.
